# FOIA / subpoena targets — close the money gaps

These are the records that upgrade **G** (gap) claims to **D** or kill them. Compulsory process already exists at HSGAC in principle; whether exercised on these line items is a separate political fact.

## Priority 1 — Unredacted NIH royalty ledger

| Field | Why it matters |
|---|---|
| Recipient (named scientist) | Confirm Fauci’s 23 payments and peers |
| Amount (USD) | Currently redacted in Open the Books pages |
| Payer / licensee | Test overlap with NIAID grantees and COVID contractors |
| Payment date | Align with trial, EUA, and grant milestones |
| Invention / patent / license ID | Tie to E-234-2016 (2P) and other ICs |

**Statute/mechanism:** FTTA / Bayh-Dole royalty splits; FOIA to HHS/NIH OTT; committee subpoena to HHS.

**What success looks like:** payer-vs-grantee matrix. Without amounts and payers, “conflict” is structural only — real, but not a personal profit proof.

## Priority 2 — OTT inventorship for E-234-2016 (2P)

| Field | Why it matters |
|---|---|
| Named inventors | Graham / Corbett / Mascola / others |
| Royalty split schedule | Who gets what fraction |
| Licensees (Moderna etc.) | Return channel to agency and persons |
| Dispute file (2021 inventorship fight) | Diary claims “considerable royalty” without inventorship control |

**Diary anchors:** 2021-04-14, 2021-08-14, 2021-11-11/12 (see `assets/diary-excerpts.js`).

## Priority 3 — Diary release manifest

| Field | Why it matters |
|---|---|
| What was withheld | Folio opens at **671** — ~670 pages missing from front |
| Selection criteria | Adversarial release bias |
| 182-day gap (2021-11-30 → 2022-05-31) | Author silence vs releaser excision |

**Ask:** HSGAC / releasing office production log, not more text analysis.

## Priority 4 — EcoHealth / R01AI110964 complete file

| Field | Why it matters |
|---|---|
| Full progress reports years 1–5 | Chimera / humanized mouse work |
| Subaward terms to WIV | BSL statements, oversight |
| Termination / debarment file | Later enforcement levers |

Already heavily litigated in public; still the cleanest Tier-2 funding chain into Tier-3 lab work.

## Priority 5 — Remdesivir procurement chain

| Field | Why it matters |
|---|---|
| HHS/ASPR purchase orders | Money trail post-ACTT-1 |
| Gilead India license agreements (public redactions) | Corrects “Fauci India trial” myth |
| WHO Solidarity vs ACTT-1 decision memos | Efficacy narrative split |

## Status legend for the instrument

| Code | Meaning |
|---|---|
| OPEN | Not in public unredacted form |
| PARTIAL | Count or summary known; dollars/payers missing |
| PUBLIC | Already in diary / OGE / grant databases |

| Target | Status |
|---|---|
| Royalty amounts to Fauci | PARTIAL (23 payments; $ redacted) |
| Royalty payers | OPEN |
| E-234-2016 inventorship schedule | PARTIAL (dispute public; split schedule not) |
| Diary withheld pages list | OPEN |
| OGE 278e (net worth bands) | PUBLIC |
| NIAID base appropriations | PUBLIC (this study’s series.js) |
| COVID supplemental to NIAID | PUBLIC ($826M + $706M) |

## How this study treats FOIA gaps

- **Structural conflict** (agency meters grants; inventors may receive third-party royalties; amounts shieldable under Bayh-Dole practice) = **D**
- **Personal dollar profit from COVID products** = **G** until Priority 1–2 land
- **No individual pharma stock in OGE** = **D** (disposes open-market insider stock story, not royalty story)
